PayNow Terms of Service - Last Updated: 3/15/25

1. Acceptance of Terms - By signing up for and using PayNow, you agree to these Terms of Service ("Terms"). If you do not agree, you may not use PayNow.
2. Nature of Services - PayNow provides a platform that facilitates cryptocurrency payments and wallet services through third-party providers, including but not limited to Crossmint, MongoDB, Coinbase, MoonPay, and other partners. PayNow does not custody, manage, or control user funds, wallets, or transactions.
3. Wallet Services - Each PayNow user is assigned a self-custody wallet through a third-party provider (e.g., Crossmint). PayNow does not store, access, or control wallet credentials, private keys, or funds. You acknowledge and agree that all wallet-related services, including transaction processing, security, and dispute resolution, are managed solely by the third-party provider.
4. Limitation of Liability - PayNow is not responsible for any errors, lost funds, transaction failures, or security breaches related to your wallet. Any issues regarding wallet access, transactions, or lost funds must be directed to the third-party provider. PayNow disclaims all liability related to the use of third-party wallets and services.
5. No Responsibility for Third-Party Security Breaches - PayNow is not responsible for, and cannot be held liable for, any hacks, security breaches, system failures, or vulnerabilities that affect any of our third-party partners, including but not limited to Crossmint, MoonPay, DBS, Coinbase, or any other integrated services. Users acknowledge that cryptocurrency transactions carry inherent risks, and PayNow is not liable for any loss of funds due to security issues beyond our direct control.
6. User Responsibilities - You are solely responsible for safeguarding your wallet credentials and ensuring the accuracy of transaction details before initiating payments. PayNow is not responsible for payments sent to incorrect addresses or errors due to user actions.
7. No Financial, Legal, or Tax Advice - PayNow does not provide financial, legal, or tax advice. You should consult with a professional before engaging in cryptocurrency transactions.
8. Arbitration Agreement & Waiver of Lawsuits - By using PayNow, you agree that any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved exclusively through binding arbitration in the state of California. You waive the right to participate in any class action lawsuit or file a claim in court, except for matters that may be resolved in small claims court.
9. Changes to Terms - PayNow reserves the right to modify these Terms at any time. Continued use of PayNow after changes are posted constitutes acceptance of the updated Terms.
10. Governing Law - These Terms shall be governed by and construed in accordance with the laws of the state of California.
